Terms of service

These Terms of Service ("Terms") govern your use of borneocoffeeco.com (the "Site") and any purchase you make from Borneo Coffee Co LLC, a Texas limited liability company ("Borneo Coffee Co.", "we", "us"). By using the Site or placing an order, you agree to these Terms. If you do not agree, please do not use the Site.
1. Who can order
You must be at least 18 years old, or have the permission of a parent or guardian, to place an order. You agree that the information you give us (name, shipping address, email, payment details) is accurate and current.
2. Products, prices, and availability
All prices are in U.S. dollars and may change at any time. Product photography is representative; coffee is an agricultural product and roast color, bean size, and flavor vary from harvest to harvest. We describe our coffee as accurately as we can and we make no claims about health benefits of any kind.
We may limit quantities, refuse or cancel any order, or discontinue a product at any time. If we cancel an order you have already paid for, we refund it in full.
Occasionally a price or description on the Site may be wrong. If an order is affected by an obvious error, we may cancel it and refund you rather than honor the error, and we will tell you why.
3. Orders and payment
Your order is an offer to buy. A confirmation email means we received it, not that we have accepted it; acceptance happens when we ship. Payment is processed by Shopify Payments and its payment partners. We never see or store your full card number. Sales tax is applied where required.
4. Shipping and risk of loss
Shipping timelines, rates, and coverage are described in our Shipping policy, which forms part of these Terms. Title passes to you on delivery to the carrier. That said, if a package is lost or damaged in transit we will still make it right under our Refund policy. That is our commitment to you regardless of who technically bears the risk.
5. Subscriptions
If you sign up for a coffee subscription:
- You authorize us to charge your payment method automatically on the schedule you chose, at the price shown at signup, until you cancel.
- We email you before each renewal so a charge is never a surprise.
- You can cancel at any time from your account or by emailing info@borneocoffeeco.com. Cancellation takes effect on all future renewals; it does not cancel a renewal already shipped.
- We will give you notice before any change to your subscription price, and you can cancel before it takes effect.
- If a payment fails, we may retry it and may pause or cancel the subscription.
6. Returns and refunds
Our Refund policy is part of these Terms and describes how we handle refunds, replacements, damaged orders, and cancellations.
7. Discounts and promotions
Discount codes are limited to one per order unless we say otherwise, cannot be applied retroactively, have no cash value, and may expire or be withdrawn at any time.
8. Your content
If you send us a review, photo, comment, or tag us on social media, you give us permission to use, display, and share that content in our marketing, with credit where practical and without payment. You confirm the content is yours to give and does not violate anyone else's rights. We may remove any content at our discretion.
9. Our content
Everything on the Site (the Borneo Coffee Co. name and logo, photography, text, and design) belongs to us or our licensors and is protected by copyright and trademark law. You may not copy, resell, or use it commercially without our written permission.
10. Acceptable use
Do not use the Site to break the law, infringe anyone's rights, upload malicious code, scrape or harvest data, interfere with the Site's operation, place fraudulent orders, or resell our products as your own without a wholesale agreement.
11. Third-party links and services
The Site links to and relies on third-party services (for example, Shopify, payment processors, shipping carriers, and email tools). We are not responsible for the content or practices of third-party sites.
12. Disclaimers
The Site and our products are provided "as is." To the fullest extent allowed by law, we disclaim implied warranties of merchantability and fitness for a particular purpose. Coffee is a natural product; our roasting facility and our supplier's facility handle coffee only, but we cannot guarantee an environment free of every allergen. Coffee contains caffeine. Nothing on the Site is medical advice.
13. Limitation of liability
To the fullest extent allowed by law, our total liability for any claim connected to your order or the Site is limited to the amount you paid for the order in question. We are not liable for indirect, incidental, or consequential damages. Some states do not allow these limits, so they may not apply to you.
14. Indemnity
You agree to indemnify and hold harmless Borneo Coffee Co LLC and its owner from claims arising out of your breach of these Terms or your misuse of the Site.
15. Governing law
These Terms are governed by the laws of the State of Texas, without regard to conflict-of-law rules. Any dispute will be brought in the state or federal courts located in Texas, and you consent to that jurisdiction. Nothing here limits any rights you have under the consumer protection laws of your own state.
16. Changes
We may update these Terms at any time. The version posted on the Site when you place an order is the one that applies to that order.
17. Severability
If any part of these Terms is found unenforceable, the rest stays in effect.
